The difficult is assessing when it is copying (stealing) and when it is appropriation (making an original new artwork based on an old one).

Koloman Moser (1868-1918), an important member of the Vienna Secession movement - popularly known as the Art Nouveau movement.

Nouveau Black (below), is Fairey's version of Moser’s art. The interesting thing is that Shepard Fairey does not give credit to the original - even though it is obvious to everyone in the art world he has based his work on it. The original piece is very well known.
